Terms of Service

These terms govern access to the Background Check website, candidate portal, verification forms, dashboard, and API unless a separate written agreement applies.

Using the Service

You may use Background Check only for lawful non-criminal workforce verification, compliance, SOC 2, GRC, and related business evidence workflows. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization.

Business users are responsible for configuring checks lawfully, providing required notices to candidates, obtaining any required consents, and making employment or engagement decisions outside the service.

Candidate and Responder Submissions

Candidates, employer contacts, and reference contacts must provide information that is accurate to the best of their knowledge. You may not submit information or evidence that you know is false, misleading, unlawful, or that you do not have the right to provide.

Identity and Biometric Processing

Certain checks use identity documents, face liveness, face comparison, document text extraction, and public professional evidence. By continuing through a candidate flow, you agree to the notices shown in the flow and consent to this processing where consent is required.

AWS is used as a service provider for Rekognition Face Liveness, Rekognition CompareFaces, and Textract processing. The service does not make automated adverse employment decisions.

Acceptable Use

  • Do not use Background Check for criminal background checks, tenant screening, credit eligibility, insurance eligibility, or any use that requires a separate regulated workflow not enabled in the service.
  • Do not attempt to bypass access controls, candidate tokens, rate limits, audit logs, or verification safeguards.
  • Do not upload malware, unlawful content, or data that is not needed for the check.
  • Do not use the service to infer protected characteristics or make decisions prohibited by applicable law.

Reports and Decisions

Reports are generated from submitted evidence, service-provider outputs, public evidence, and reviewer activity. They may contain errors or incomplete evidence. Business customers are responsible for reviewing reports, handling disputes, complying with applicable notice/adverse-action obligations, and making final decisions.

Data and Privacy

Our processing of personal data is described in the Privacy Notice. Retention defaults are 7 days for raw verification artifacts and 365 days for terminal structured check records and reports, unless changed by configuration or required by law.

Availability and Changes

We may change, suspend, or discontinue parts of the service. The service is provided using reasonable care, but it may be unavailable, delayed, or inaccurate. To the maximum extent permitted by law, Comp AI disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, or punitive damages.
